\\ Caccamo's Waive Extradition, Headed Back to Coweta County to Face Charges

Booking documents from the Harrison County, MS jail were the Caccamo's are currently being held show that they have both waived extradition back to Coweta County, a move that will see them returning to Coweta County in the next several days. Once they return they'll be booked into the Coweta County Jail.

The Interstate Extradition Process

Warrants

This process started when the Coweta County Superior Court issued an Arrest Warrant for both Ryan and Catherine. These warrants direct law enforcement in any jurisdiction to arrest the named defendant and hold them while contacting the issuing authority. In this case Superior Court Judge Bedinger signed the warrants on October 15th, the day after the indictments were returned.

Court Appearance ( In Mississippi ) & Extradition Decision

The next step of the process is for the individual to go before a judge in the asylum state, basically whatever state they are arrested in, in this case Mississippi. At this hearing the individual is informed of the charges for which they are being held, which in this case involves reading them the counts returned in the indictment, and advises them on their rights regarding extradition - for which they have two choices.

  1. Fight it - They can demand formal extradition papers which requires a governors warrant be issued by the demanding state, Georgia in this case, and be delivered to the asylum states governor. This warrant includes extra documentation regarding the charges, the origination of the charges, etc. that are reviewed by the asylum states governor. Once they agree all is in order, they than issue their own warrant for the transfer of the individual to the demanding state. While there are some things a defendant can argue during this process, their guilt is not part of it. This process can takes weeks to months and the individuals remain in jail throughout.
  2. Waive it - In this case, which is what has happened here, the individual signs a document waiving their right to the governors warrant process allowing the asylum state to release them to the demanding states agents.

The Transfer

Given the result of either process above results in the release of the individual to the demanding state, the transfer works in the same manner. The demanding state schedules transport from where they are back to where the charges originate from. This can be done by sending deputies or in some cases contracted extradition agents to take custody of them and depending on distance either fly them or drive them back. In my experience covering the county, they will probably fly deputies out and return them the same way.

In the latest case that I covered in which a governors warrant was issued for an individual that was already in jail for charges in Delaware, investigators were flown to the area to bring them back, but had additional investigative task while there. That suspect was charged the full cost of his transfer including airfare and other costs.

Arrival

Once back in Coweta County they will be booked into the Coweta County jail and the case will follow the normal course including bond hearings, arraignments ( currently scheduled for February 16, 2027 ), etc. In the vast majority of cases with similar charges bond is very rare unless the case drags out for an extended period of time. Even then given their established roots in Mississippi the possibility of trying to run would seem higher than normal.

Whats Next

With the couple waiving their extradition, it's expected they will be transferred back to Coweta sometime early next week. Once they settle into the normal case process, they'll either need to apply for a public defender or hire a private attorney.
